The Platform is intended for use by individuals who are at least 18 years old. By using the Platform, you represent and warrant that you meet this age requirement.
a. License: Subject to these Terms, Orkle grants you a non-exclusive, non-transferable, revocable license to use the Platform for your personal and non-commercial use. b. Restrictions: You agree not to use the Platform in any way that: - Violates any applicable law or regulation; - Infringes the rights of any third party, including intellectual property rights; - Is harmful, fraudulent, deceptive, threatening, harassing, defamatory, obscene, or otherwise objectionable; - Jeopardizes the security of your Orkle account or anyone else’s account; - Attempts to gain unauthorized access to the Platform, other accounts, computer systems, or networks connected to the Platform.
You may be required to register for an account to access certain features of the Platform. You agree to (a) provide accurate, current, and complete information as may be prompted by any registration forms on the Platform; (b) maintain the security of your password; (c) maintain and promptly update the registration data, and any other information you provide to Orkle; and (d) accept all risks of unauthorized access to the registration data and any other information you provide to Orkle.
All intellectual property rights in the Platform and Services, including the design, graphics, text, interfaces, and the selection and arrangements thereof, are owned by Orkle or its licensors. Any use of the Platform or Services not expressly permitted by these Terms is a breach of these Terms and may violate copyright, patent, trademark, and other laws.
The Platform may contain links to third-party websites or resources. Orkle provides these links only as a convenience and is not responsible for the content, products, or services on or available from those websites or resources. You acknowledge sole responsibility for and assume all risk arising from your use of any third-party websites or resources.
The Platform and Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. Orkle disclaims all warranties, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Orkle, its affiliates, and their licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Platform; (b) any conduct or content of any third party on the Platform; (c) any content obtained from the Platform; and (d) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not Orkle has been informed of the possibility of such damage.
You agree to defend, indemnify, and hold harmless Orkle, its affiliates, licensors, and their employees, contractors, agents, officers, and directors, from and against any claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Platform, by you or any person using your account and password; b) a breach of these Terms, or c) Content posted on the Platform.
These Terms shall be governed and construed in accordance with the laws of UAE, without regard to its conflict of law provisions.
Orkle is not responsible for any losses incurred as a result of network issues, exchanges, or during the transfer of NFTs or funds. This includes, but is not limited to, losses due to technical failures, network congestion, or any other problems inherent in the use of blockchain technologies and digital asset exchanges. You acknowledge that transactions of digital assets can be irreversible and that Orkle has no control over the internal functioning of blockchain networks or digital asset exchanges.
Orkle is not liable for any loss or damage arising from unauthorized access to your account or theft of your digital assets. You are responsible for maintaining the confidentiality of your account information, including your password, and for any and all activities that occur under your account. You agree to notify Orkle immediately of any unauthorized use of your account or any other breach of security. Orkle will not be liable for any acts or omissions by you, including any damages of any kind incurred as a result of such acts or omissions.
You accept and acknowledge that there are risks associated with utilizing an internet-based platform to transfer digital assets, including, but not limited to, the risk of failure of hardware, software, and internet connections, the risk of malicious software introduction, and the risk that third parties may obtain unauthorized access to information stored within your account. You accept and acknowledge that Orkle will not be responsible for any communication failures, disruptions, errors, distortions, or delays you may experience when using the Platform, however caused.
Orkle does not endorse, verify, or assume responsibility for any third-party services, including the operation of digital asset exchanges or the security of blockchain networks. Your use of such services is solely at your own risk and discretion. Orkle expressly disclaims any liability for the acts, omissions, or failures of any third-party service provider, network, or blockchain.
Orkle’s obligations under these Terms are limited to providing the Platform and Services as described. Orkle does not warrant the availability or uninterrupted use of the Platform and Services. Orkle reserves the right to suspend or withdraw the whole or any part of the Platform or Services at any time without notice and without incurring any liability.
Orkle reserves the right to modify, suspend, or discontinue, temporarily or permanently, the Platform or any service to which it connects, with or without notice and without liability to you.
Orkle reserves the right, at its sole discretion, to amend or update these Terms at any time to reflect changes to the law or changes to our Platform or Services. We will provide notice of any changes by posting the new Terms on the Platform. Your continued use of the Platform and Services after the posting of any changes to the Terms constitutes acceptance of those changes.
